Terms of Service

for Broken Spoke Bicycles Limited

1. Introduction and Acceptance

Broken Spoke Bicycles Limited is registered with the Financial Conduct Authority (FCA), number 31918R.

These Terms of Service ("Terms") govern your use of the website and all programmes, services, and facilities offered by Broken Spoke Bicycles Limited (referred to herein as “the organisation” or Broken Spoke).

By accessing, booking, or using any part of our services, you agree to be bound by these Terms, our Privacy Policy, and all associated policies referenced below.

2. Programmes and Scope of Services

These Terms apply to all services and programmes offered by Broken Spoke, including but not limited to:

  1. Cycle Training Programmes: Group and individual on-road/off-road cycle instruction. 

  2. DIY Workshop Access: Rental or purchase of space, tools, and equipment for personal bike maintenance.

  3. Educational Workshops: Non-training focused classes, talks, and demonstrations. 

  4. Retail and Repair Services: Sale of products and professional mechanical services.

3. User Eligibility, Age Restrictions, and Supervision

  1. Required Supervision for Minors: All minors (under 18) attending any Programme or accessing our premises must be accompanied and actively supervised by a responsible adult (aged 18 or older) at all times. 

  2. Mechanical Work Prohibition: No individual under the age of 18 is permitted to engage in mechanical work, repairs, or maintenance on bicycles or bike parts using our tools or premises, regardless of whether adult supervision is present. This restriction is enforced for safety and liability reasons.

  3. DIY Workshop Restrictions: Access to the DIY Workshop is strictly prohibited for individuals under the age of 18. An adult must make any booking for DIY Workshop Access, and children are not permitted in the DIY workshop area.

  4. Guardian Consent: Broken Spoke reserves the right to require signed guardian consent forms before allowing anyone under the age of 18 to participate actively in any space.

4. Safety, Safeguarding, and Code of Conduct

  1. Commitment to Safeguarding: Broken Spoke is committed to the protection and well-being of all participants. We operate under a dedicated Safeguarding Policy, which is available. All users and their accompanying adults must comply with this policy. 

  2. Staff Vetting and Background Checks: All instructors, coaches, and staff involved in direct contact with minors, especially those running Cycle Training Programmes, have undergone and maintained satisfactory enhanced criminal record checks, such as those provided by the Disclosure and Barring Service (DBS) in the UK, or equivalent checks in other jurisdictions. 

  3. Required Conduct: Users must conduct themselves in a safe, respectful, and appropriate manner at all times. Use of our premises or services for any illegal or dangerous purpose is strictly prohibited. 

  4. Right to Refuse Service: We reserve the right to immediately terminate the service or participation of any user (or their accompanying adult) who violates these Terms, poses a safety risk, or violates our Safeguarding or Safer Spaces Policies. 

  5. Reporting Concerns: Any user who has a safeguarding concern must report it immediately to admin@bsbcoop.org, as outlined in the Safeguarding Policy, or directly to the relevant authorities.

5. Liability and Risk Acknowledgement

  1. Assumption of Risk: You acknowledge that participation in Cycle Training Programmes and use of the DIY Workshop involves inherent risks, including property damage, personal injury, and death. You voluntarily assume these risks. 

  2. Personal Property: Broken Spoke is not responsible for the theft, loss, or damage to personal property brought onto the premises or used during Programmes.

  3. Limitation of Liability: Our liability for any breach of these Terms is limited to the fees you paid for the specific Programme or Service giving rise to the claim, except where prohibited by law (e.g., liability for death or personal injury caused by our negligence).

6. Data Protection and Privacy

  1. Privacy Policy: When you use our website, book a service, or provide information to us, you consent to the collection and use of your data in accordance with our separate Privacy Policy, available here. This Policy outlines the types of data we collect, how we use it, and your rights concerning that data.

  2. Data Commitment: We are committed to protecting the privacy of your personal information and handling your data in compliance with relevant data protection legislation (e.g., GDPR). 

  3. User Submissions: Any information or data you submit through the website (e.g., booking forms, contact forms) will be used solely for the purpose for which it was collected (e.g., processing your booking, providing the service, responding to enquiries).

  4. Security: We employ industry-standard security measures designed to protect your data from unauthorised access, disclosure, alteration, or destruction.

7. Financial, Sales, and Warranty Policies

  1. Statutory Consumer Rights: All rights outlined in this section are offered in addition to your legal rights as a consumer under the Consumer Rights Act (2015), including the right to claim a refund, replacement, or repair where goods are faulty or misdescribed.

  2. Bike Sales & Goodwill Policy: If, within two weeks of purchase, you find that the bike does not fully meet your needs, you may return it in the same condition as sold to exchange for another bike or receive a full refund if no suitable alternative is available.

  3. Programme Cancellation and Refunds (Customer)

    1.  Bike Maintenance Courses: A 5-day cancellation notice is required; cancellation within 5 days forfeits payment. 

    2. DIY Workshop Sessions: A 2-day cancellation notice is required; cancellation within 2 days forfeits payment. 

    3. Cycle Training (1:1): 72-hour cancellation notice required; cancellation inside 72 hours forfeits payment. If training is subsidised, the employer or university will still be billed, and the session will be deducted from your allowance.

  4. Programme Cancellation and Refunds (Organisational): If Broken Spoke cancels a session for any reason (e.g., due to being unsubscribed), we will notify you immediately and offer you the option to reschedule for a future date or receive a full refund.

8. Governing Law

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.
